บริษัท เจ.เอส.91 จำกัด บังคับใช้เมื่อ 22 กรกฎาคม 2569 แก้ไขเพิ่มเติมครั้งที่ 1 เมื่อ 23 กรกฎาคม 2569 บทนำ บริษัท เจ.เอส.91 จำกัด (J.S.91 Company Limited) ("บริษัท", "เรา", "ของเรา") ในฐานะผู้ให้บริการแอปพลิเคชัน 88.5 Sweet FM ให้ความสำคัญกับการคุ้มครองข้อมูลส่วนบุคคลของผู้ใช้งานทุกท่าน และมุ่งมั่นดำเนินการตามพระราชบัญญัติคุ้มครองข้อมูลส่วนบุคคล พ.ศ. 2562 (PDPA) รวมถึงมาตรฐานด้านความเป็นส่วนตัวของ Apple App Store และ Google Play นโยบายฉบับนี้อธิบายถึงการเก็บรวบรวม การใช้ การเปิดเผย และการดูแลรักษาข้อมูลส่วนบุคคลของผู้ใช้งานเมื่อใช้บริการแอปพลิเคชัน 88.5 Sweet FM 1. ผู้ควบคุมข้อมูลส่วนบุคคล บริษัท เจ.เอส.91 จำกัด ที่อยู่: เลขที่ 9 ถนนสามเสน แขวงถนนนครไชยศรี เขตดุสิต กรุงเทพมหานคร เว็บไซต์: 885sweetfm.com อีเมลสำหรับติดต่อ: sweetchannelpr@gmail.com 2. ข้อมูลส่วนบุคคลที่เราเก็บรวบรวม เมื่อท่านสมัครสมาชิกหรือใช้งานแอป เราอาจเก็บข้อมูลดังต่อไปนี้ 2.1 ข้อมูลที่ผู้ใช้ให้แก่เรา - ชื่อ-นามสกุล - วัน เดือน ปีเกิด - อีเมล - รหัสผ่าน (จัดเก็บในรูปแบบที่มีการเข้ารหัสผ่านระบบ Authentication) - ข้อความที่ผู้ใช้ส่งถึง DJ ผ่านระบบแชท 2.2 ข้อมูลที่เก็บโดยอัตโนมัติ เมื่อใช้งานแอป เราอาจได้รับข้อมูลทางเทคนิค เช่น - ประเภทอุปกรณ์ - ระบบปฏิบัติการ - เวอร์ชันของแอป - Token สำหรับการรับ Push Notification - ข้อมูลการเข้าสู่ระบบผ่าน Firebase Authentication ทั้งนี้ บริษัทไม่มีวัตถุประสงค์ในการเก็บข้อมูลตำแหน่ง (Location) หรือข้อมูลที่มีความอ่อนไหวของผู้ใช้งาน 3. วัตถุประสงค์ในการใช้ข้อมูล บริษัทใช้ข้อมูลส่วนบุคคลของท่านเพื่อวัตถุประสงค์ดังต่อไปนี้ - สมัครสมาชิก - ยืนยันตัวตนผู้ใช้งาน - ให้บริการเข้าสู่ระบบ - ส่งการแจ้งเตือนข่าวสารและรายการวิทยุ - ให้ผู้ใช้งานสามารถส่งข้อความถึง DJ - ให้บริการฟังวิทยุออนไลน์ - ปรับปรุงคุณภาพการให้บริการ - วิเคราะห์และแก้ไขปัญหาทางเทคนิค - ปฏิบัติตามกฎหมายที่เกี่ยวข้อง 4. ฐานทางกฎหมายในการประมวลผลข้อมูล บริษัทประมวลผลข้อมูลส่วนบุคคลของท่านบนฐานทางกฎหมาย ดังต่อไปนี้ - การปฏิบัติตามสัญญา (Contract) - ความยินยอมของเจ้าของข้อมูล (Consent) - ประโยชน์โดยชอบด้วยกฎหมายของบริษัท (Legitimate Interest) - การปฏิบัติตามกฎหมาย (Legal Obligation) 5. การเปิดเผยข้อมูลส่วนบุคคล บริษัทจะไม่ขายหรือให้เช่าข้อมูลส่วนบุคคลแก่บุคคลภายนอก อย่างไรก็ตาม บริษัทอาจเปิดเผยข้อมูลแก่ผู้ให้บริการที่จำเป็นต่อการดำเนินงานของแอป ได้แก่ - Google Firebase Authentication - Firebase Cloud Messaging (Push Notification) - ผู้ให้บริการ Cloud Hosting - หน่วยงานของรัฐ เมื่อกฎหมายกำหนด ผู้ให้บริการดังกล่าวจะเข้าถึงข้อมูลเฉพาะเท่าที่จำเป็นต่อการให้บริการ และต้องปฏิบัติตามมาตรฐานด้านความปลอดภัยของข้อมูล 6. การใช้บริการของบุคคลที่สาม แอปอาจเชื่อมโยงหรือใช้งานบริการของบุคคลที่สาม ได้แก่ - Google Firebase - Google Sign-In - Apple Sign-In - YouTube เมื่อผู้ใช้งานเลือกใช้บริการดังกล่าว การประมวลผลข้อมูลบางส่วนจะอยู่ภายใต้นโยบายความเป็นส่วนตัวของผู้ให้บริการนั้น 7. การเก็บรักษาข้อมูล บริษัทจะเก็บรักษาข้อมูลส่วนบุคคลไว้ตราบเท่าที่จำเป็นต่อการให้บริการ หรือเท่าที่กฎหมายกำหนด เมื่อหมดความจำเป็น บริษัทจะดำเนินการลบหรือทำให้ข้อมูลไม่สามารถระบุตัวตนของเจ้าของข้อมูลได้อย่างปลอดภัย 7.1 ระยะเวลาการเก็บรักษาข้อมูลส่วนบุคคล - ข้อมูลบัญชีสมาชิก (เช่น ชื่อ-นามสกุล วันเดือนปีเกิด และอีเมล) จะถูกเก็บไว้ตลอดระยะเวลาที่บัญชีผู้ใช้งานยังคงมีการใช้งาน - ข้อมูลการยืนยันตัวตน จะถูกจัดเก็บตามมาตรฐานของระบบ Firebase Authentication เพื่อรองรับการเข้าสู่ระบบและการรักษาความปลอดภัยของบัญชีผู้ใช้งาน - ข้อมูลการแจ้งเตือน (Push Notification Token) จะถูกเก็บไว้เพื่อให้บริการส่งการแจ้งเตือน และจะถูกลบหรือยกเลิกเมื่อผู้ใช้งานปิดการรับการแจ้งเตือนหรือยกเลิกการใช้งานแอป - เมื่อผู้ใช้งานดำเนินการ ลบบัญชีผู้ใช้ บริษัทจะดำเนินการลบหรือทำให้ข้อมูลส่วนบุคคลไม่สามารถระบุตัวตนได้ภายใน 90 วัน นับจากวันที่ได้รับคำขอ เว้นแต่มีความจำเป็นต้องเก็บรักษาข้อมูลไว้ตามกฎหมาย หรือเพื่อการดำเนินการตามข้อพิพาทหรือการบังคับใช้สิทธิทางกฎหมาย บริษัทจะดำเนินการลบหรือทำให้ข้อมูลส่วนบุคคลไม่สามารถระบุตัวตนได้อย่างปลอดภัยเมื่อพ้นระยะเวลาการเก็บรักษาหรือเมื่อข้อมูลดังกล่าวหมดความจำเป็นต่อวัตถุประสงค์ในการประมวลผลแล้ว 8. ความปลอดภัยของข้อมูล บริษัทใช้มาตรการด้านเทคนิคและการบริหารจัดการที่เหมาะสม เพื่อป้องกันการเข้าถึง การเปิดเผย การเปลี่ยนแปลง หรือการทำลายข้อมูลโดยไม่ได้รับอนุญาต รวมถึง - ระบบ Firebase Authentication - การเข้ารหัสข้อมูลระหว่างการรับส่ง (HTTPS/TLS) - การกำหนดสิทธิ์การเข้าถึงข้อมูลของผู้ดูแลระบบ 9. สิทธิของเจ้าของข้อมูล ผู้ใช้งานมีสิทธิตามกฎหมาย PDPA ได้แก่ - สิทธิในการรับทราบข้อมูล - สิทธิในการเข้าถึงข้อมูลส่วนบุคคล - สิทธิในการแก้ไขข้อมูล - สิทธิในการถอนความยินยอม - สิทธิในการลบข้อมูลส่วนบุคคล - สิทธิในการคัดค้านการประมวลผลข้อมูล - สิทธิในการโอนย้ายข้อมูล (ในกรณีที่กฎหมายกำหนด) ผู้ใช้งานสามารถใช้สิทธิดังกล่าวได้โดยติดต่อบริษัทตามข้อมูลในหัวข้อ "ติดต่อเรา" 10. การลบบัญชีผู้ใช้งาน ผู้ใช้งานสามารถลบบัญชีผู้ใช้งานผ่านเมนูตั้งค่า (Settings) ภายในแอปได้ เมื่อมีการลบบัญชี บริษัทจะดำเนินการลบหรือระงับข้อมูลส่วนบุคคลของผู้ใช้งานภายในระยะเวลาที่เหมาะสม เว้นแต่กรณีที่กฎหมายกำหนดให้ต้องเก็บรักษาข้อมูลไว้ 11. การเปลี่ยนแปลงนโยบาย บริษัทอาจปรับปรุงนโยบายความเป็นส่วนตัวเป็นครั้งคราว เพื่อให้สอดคล้องกับกฎหมาย เทคโนโลยี หรือการให้บริการที่เปลี่ยนแปลงไป หากมีการเปลี่ยนแปลงสาระสำคัญ บริษัทจะแจ้งให้ผู้ใช้งานทราบผ่านแอปพลิเคชันหรือเว็บไซต์ 12. นโยบายเกี่ยวกับผู้เยาว์ (Children's Privacy) แอปพลิเคชัน 88.5 Sweet FM ไม่มีวัตถุประสงค์ในการเก็บรวบรวมข้อมูลส่วนบุคคลจากเด็กที่มีอายุต่ำกว่า 13 ปีโดยเจตนา หากบริษัทตรวจพบว่ามีการเก็บรวบรวมข้อมูลส่วนบุคคลของเด็กอายุต่ำกว่า 13 ปีโดยไม่ได้รับความยินยอมจากผู้ปกครองหรือผู้ใช้อำนาจปกครอง บริษัทจะดำเนินการลบข้อมูลดังกล่าวออกจากระบบโดยเร็วที่สุด หากท่านเชื่อว่าบุตรหลานของท่านได้ให้ข้อมูลส่วนบุคคลแก่บริษัทโดยไม่ได้รับอนุญาต กรุณาติดต่อบริษัทผ่านช่องทางที่ระบุไว้ในหัวข้อ "ติดต่อเรา" เพื่อให้บริษัทดำเนินการตรวจสอบและลบข้อมูลดังกล่าว 13. การโอนข้อมูลไปยังต่างประเทศ (International Data Transfer) เพื่อให้สามารถให้บริการแอปพลิเคชันได้อย่างมีประสิทธิภาพ บริษัทอาจใช้บริการของผู้ให้บริการภายนอก เช่น Google Firebase ซึ่งอาจมีการประมวลผลหรือจัดเก็บข้อมูลบนเซิร์ฟเวอร์ที่ตั้งอยู่ในประเทศไทยหรือประเทศอื่น บริษัทจะดำเนินการเลือกใช้ผู้ให้บริการที่มีมาตรฐานด้านความปลอดภัยของข้อมูลที่เหมาะสม และดำเนินมาตรการที่จำเป็นเพื่อให้การโอนข้อมูลส่วนบุคคลเป็นไปตามกฎหมายคุ้มครองข้อมูลส่วนบุคคลของประเทศไทย รวมถึงข้อกำหนดด้านความปลอดภัยของผู้ให้บริการนั้น การใช้บริการของบุคคลที่สามดังกล่าวจะอยู่ภายใต้นโยบายความเป็นส่วนตัวและมาตรฐานการรักษาความปลอดภัยของผู้ให้บริการแต่ละราย 14. ติดต่อเรา หากมีข้อสงสัยเกี่ยวกับนโยบายความเป็นส่วนตัว หรือประสงค์จะใช้สิทธิของเจ้าของข้อมูลส่วนบุคคล สามารถติดต่อได้ที่ บริษัท เจ.เอส.91 จำกัด (J.S.91 Company Limited) ที่อยู่: เลขที่ 9 ถนนสามเสน แขวงถนนนครไชยศรี เขตดุสิต กรุงเทพมหานคร เว็บไซต์: 885sweetfm.com อีเมล: sweetchannelpr@gmail.com
